The European bedding and furniture market is undergoing a massive shift toward circularity and sustainability. If your e-commerce business sells mattresses or mattress toppers to consumers or businesses in Belgium, you are subject to strict Extended Producer Responsibility (EPR) regulations.

1. Introduction to EPR in Belgium

Extended Producer Responsibility (EPR) is an environmental policy that makes the party who first places a product on the market legally and financially responsible for its end-of-life management.

Because mattresses are bulky, difficult to transport, and composed of complex, heavily blended materials (foam, latex, metal, textiles), their disposal puts a massive strain on local municipalities. Belgium's EPR system shifts the cost of collecting, dismantling, and recycling old mattresses directly to the producers, importers, and online sellers. The goal is to maximize material recovery—turning old foam into insulation or new bedding materials—and to encourage eco-friendly product design.

2. Legal Framework and Regulations in Belgium

In Belgium, the EPR mandate for mattresses is governed by regional environmental agreements across Flanders, Wallonia, and the Brussels-Capital Region.

To streamline compliance across the country, the regions authorized a single, centralized Producer Responsibility Organization (PRO) named Valumat. Founded by the Belgian industry associations (including Fedustria and Navem), Valumat officially launched its operations on January 1, 2021. All legal obligations regarding mattress take-back, reporting, and eco-fee collection in Belgium are funneled through the Valumat system.

3. Who Must Register for EPR Mattresses in Belgium?

The obligation falls on the "producer" or the entity placing the mattress on the Belgian market for the first time. You must register with Valumat if you:

Manufacture mattresses in Belgium.
Import mattresses into Belgium for domestic sale.
Operate as a Foreign Distance Seller (E-commerce): If your business is located outside of Belgium (e.g., Germany, China, Poland) and you sell mattresses or toppers directly to Belgian private households (B2C) via your own website or marketplaces like Amazon and Bol.com, you are fully obligated to comply.

Note: If a Belgian consumer buys a mattress directly from a foreign webshop, the foreign shop assumes the legal take-back and financial obligations.

4. EPR Categories: Mattresses

The Valumat system covers a wide range of sleeping surfaces. Under Belgian EPR law, a product is considered a mattress if it consists of a strong cover filled with core materials and is designed to be placed on a supporting bed structure.

To accurately report your sales, you must classify your products into the following categories based on size and user:

Children's Mattresses: Mattresses with maximum dimensions of 70 x 140 cm. (Note: Crib and cot mattresses with a height of ≤ 40 mm and a surface area of ≤ 0.8 m² are generally excluded).
Single Mattresses & Toppers: Mattresses and mattress toppers with a width of 120 cm or less (≤ 120 cm).
Double Mattresses & Toppers: Mattresses and mattress toppers with a width greater than 120 cm (> 120 cm).

Crucial Detail: Mattress toppers are explicitly included in the Belgian EPR scheme and must be reported and paid for just like full-sized mattresses.

5. EPR Registration Process in Belgium for Mattresses

Achieving legal compliance to sell mattresses in Belgium involves the following administrative steps:

Join Valumat: You must sign a legally binding accession agreement with Valumat, the national take-back scheme.
Marketplace Submission: Once your registration is processed, you will receive a unique EPR registration number for mattresses (typically formatted as M-XXXX). You must upload this number to your seller portals on platforms like Amazon and Bol.com to prove compliance and keep your listings active.
Invoice Updating: Ensure your invoicing and pricing structures account for the mandatory environmental fees required by Belgian law.

6. Authorized Representative Requirements in Mattresses

For international e-commerce sellers without a physical presence in Belgium, managing localized EPR obligations can be legally complex.

Direct Registration vs. Representation: While Valumat allows foreign sellers to register directly for their B2C sales, navigating the reporting portal, understanding the specific legal definitions of excluded products, and managing local marketplace requirements often necessitates local expertise.

Many foreign sellers opt to use an Authorized Representative or Compliance Partner to handle their Valumat account, act as the local liaison, and assume the administrative burden of calculating and submitting the annual sales declarations.

7. Reporting Obligations and Deadlines in Mattresses

Transparency is mandatory. Once registered with Valumat, you are legally required to declare the exact number and size category of mattresses and toppers you placed on the Belgian market.

Reporting Frequency: Declarations are submitted annually.
The Deadline: You must submit your sales report for the previous calendar year by March 31st of the current year.
Zero-Reporting: Even if you did not sell any mattresses in Belgium during a specific year, you must still log into the portal and submit a "zero report" to maintain an active, compliant status.

8. EPR Fees and Eco-Contributions in Mattresses

Your financial contribution directly funds the logistics of collecting and dismantling old mattresses across Belgium's recycling parks and retail networks.

The Environmental Fee: You pay a fixed fee per item sold, based entirely on its size category. The Valumat General Assembly reviews and sets these rates annually based on actual recycling costs.
Estimated Costs: While rates fluctuate, expect to pay roughly €4.00 to €5.00 for children's mattresses, €8.00 to €9.00 for single mattresses/toppers, and €16.00 to €18.00 for double mattresses/toppers (inclusive of VAT).
Invoicing Rules: For B2B sales, the environmental fee must be explicitly stated on the invoice. For B2C sales to consumers, stating it on the receipt is optional, but you must clearly inform the consumer about the fee's existence (e.g., via your website or product pages).

9. Labeling Requirements and Compliance

Belgium does not currently mandate a specific, unique physical recycling logo stitched into the mattress solely for the national market.

Consumer Information: The primary "labeling" compliance in Belgium relates to transparency. You must inform your buyers that the purchase price includes an environmental contribution that funds end-of-life recycling.
Standard EU Rules: Ensure your mattresses comply with broader EU textile labeling regulations and CE marking requirements (if applicable to specific motorized or medical beds).

10. Penalties for Non-Compliance

Operating outside the Valumat system carries severe risks for your business:

Marketplace Bans: E-commerce platforms act as strict regulatory gatekeepers. If you cannot provide a valid Valumat EPR number, Amazon, Bol.com, and other platforms will immediately block your mattress and topper listings from the Belgian market.
Retroactive Fines: Valumat and Belgian authorities can audit your historical sales and demand retroactive payment of all unpaid eco-contributions, accompanied by heavy administrative fines for negligence.
